Public Notice: Notice of the passing of Development Charges By-law
NOTICE OF PASSING OF DEVELOPMENT CHARGES BY-LAW BY THE TOWN OF SMITHS FALLS
TAKE NOTICE that the Council of the Town of Smiths Falls passed Development Charges By-law 10324-2022 on March 21, 2022, under Section 2 of the Development Charges Act, 1997.
AND TAKE NOTICE that any person or organization may appeal to the Ontario Land Tribunal (OLT) under section 14 of the Act, in respect of the Development Charges By-Law, by filing with the Clerk of The Town of Smiths Falls on or before Monday, May 2, 2022, a notice of appeal setting out the objection to the By-law and the reasons supporting the objection. Appeals filed with the Office of the Clerk at 77 Beckwith St N, Smiths Falls, ON K7A 2B8, will be accepted on or before Monday, May 2, 2022. A fee is applicable with the appeal application. The appellant is advised to contact the OLT to access the required forms and applicable Provincial fees.
The charges in the aforementioned by-law will apply to all new residential and non-residential development, subject to certain terms, conditions and limited exemptions as identified therein.
Town-wide development charges are levied against new development to pay for the increased capital costs related to the provision of such town services as Library Services, Parks and Recreation, Fire Protection Services, Police Services, Development Related Studies, Services Related to a Highway (Public Works and Roads and Related), Water Services, and Wastewater Services. Schedule A of the by-law outlines these designated town services.
The development charges are calculated on a “per unit” basis for residential development and on a “square metre” basis for non-residential development. Schedule B below sets out the residential development charge rates applicable throughout the Town of Smiths Falls. Schedule C below sets out the non-residential development charge rates applicable throughout the Town of Smiths Falls. A key map has not been provided as the Town-wide charges apply to all lands located within the boundaries of the Town of Smiths Falls.
The development charges imposed under the By-law come into effect on the 1st day of June 2022. Copies of the complete Development Charges By-law is available for examination on the website here: Development Charges By-law.
